Imagine a game in which you and an opponent are simultaneously playing chess on five different boards. For your opponent to win this game, he has to win all five boards. For you to win this game, you only have to win one of the five boards. If you and your opponent are even remotely evenly matched, you’re going to feel pretty good about your chances, right? That’s the scenario House Democrats are facing in their battle to investigate and expose Donald Trump’s crimes.


House Democrats are now fighting procedural and legal battles to get their hands on Donald Trump’s financial records from the U.S. Treasury, Deutsche Bank, JP Morgan Chase, Mazars, and Capital One. Trump is taking legal action to try to block all five avenues. He’ll probably succeed when it comes to the Treasury. He’ll almost certainly fail in his attempts at telling the four financial institutions what they’re allowed to do with documents in their possession.



But the point is, the Democrats only need to win one of these five battles, and voila, they’ve instantly got their hands on a treasure trove of Donald Trump’s financial records. Yesterday we even learned that Deutsche Bank has multiple years of Trump’s tax returns in addition to his banking records, and is turning them over to House Democrats as soon as Trump’s fleeting legal efforts fail.



This asymmetrical situation, in which House Democrats only have to win one round in order to win the contest, and Donald Trump has to win every round in order to win the contest, also applies to other aspects of their larger ongoing battle. The Democrats don’t need all of Trump’s former advisers to come forward and publicly testify about his obstruction of justice. The more the merrier, but they only need one of them to agree to go before the television cameras in order to make the case to the American people.


If you’re playing a game where you have to win every single round in order to be declared the winner, you only stand a chance if you’re orders of magnitude better at this game than your opponent is. Donald Trump is not orders of magnitude better at this than the House Democrats are. The math alone makes clear why Trump is extraordinarily unlikely to win his battle with the Democrats.

Someone needs to get Attorney General William Barr a dictionary. And fast. Wednesday’s hearing in the Senate revealed that the head of the DOJ has considerable trouble with a number of fairly common English words. “I’m trying to grapple with the word ‘suggest’”, he said in an exchange with Kamala Harris when the Senator was trying to find out whether Donald Trump or anyone at the White House had ever asked or suggested that he open an investigation into anyone. Harris helpfully supplied a number of synonyms – “hinted”, “inferred” – but Bill Barr still came up with a non-answer to the question the Senator had to ask him twice.


Interestingly, on the same day that A. G. Barr claimed he didn’t know of any efforts on the part of the White House to get the DOJ involved in any investigation, an article in the New York Times (“Biden Faces Conflict of Interest Questions That Are Being Promoted by Trump and Allies”) stated that “Mr. Trump [ … ] recently suggested he would like Attorney General William P. Barr to look into the material gathered by the Ukrainian prosecutors – echoing repeated calls from Mr. Giuliani for the Justice Department to investigate the Bidens’ Ukrainian work and other connections between Ukraine and the United States.” Make of that what you will when you decide about the Attorney General’s truthfulness.



Another word that Bill Barr seems to have trouble with is the word “spying”. He used it liberally to describe the FBI’s investigation into the 2016 Trump campaign, and when confronted with the question of whether he would characterize other legitimately authorized activities of intelligence services as spying, he denied that the word had a negative and sinister connotation.



The third word the U.S. Attorney General seems to be confused about is “transparency,” While he likes to use it quite often to describe his handling of the Mueller report, he somehow seems to get it mixed up with obfuscation. Instead of using the Senate hearing to finally come clean about his mishandling of the report the Special Counsel placed into his hands, Barr again neglected to provide the whole truth by never mentioning the fact that the letter whose existence was revealed by the Washington Post the day before the hearing was not the first but the second letter Mueller had written to him in response to the Attorney General’s now infamous four-page summary/non-summary letter. William Barr also responded to a request by Senator Blumenthal to be given access to the notes that were taken on the subsequent phone conversation between Barr and Mueller with a flat-out “No.” That is not what the word “transparency” means.


All in all, A. G. Barr proved that he is rather good at running down the clock, obfuscation and stonewalling which is why House Judiciary Democrats did exactly the right thing when they insisted on the format of a hearing that would have a thirty minute round of uninterrupted questioning by a staff lawyer in addition of the usual five minute rounds of answering questions posed by committee members. They are also right when they ask for Attorney General William Barr to resign.

After Special Counsel Robert Mueller’s letter to William Barr surfaced just in time to change the entire parameters of Barr’s congressional testimony about the Mueller report, Palmer Report predicted that Mueller would soon take control of the situation entirely. We simply didn’t know what that would look like. Now it turns out Mueller has just taken a big step in the name of taking over the process.



Because Robert Mueller is still technically a Department of Justice employee – or at least he was as of a couple days ago – Congress is supposed to go through his boss in order to schedule Mueller to testify. But NBC News just reported that Mueller is now negotiating directly with House Democrats about testifying. This is a big deal for two reasons.



First, it means that Robert Mueller no longer considers himself beholden to William Barr or Donald Trump’s DOJ on any level. Did Mueller just resign without announcing it? Is he planning to resign any minute now? We don’t know yet. But we do know that Mueller clearly doesn’t believe that he answers to the DOJ anymore.


Second, the key words in this NBC report are “House Democrats.” If this is completely accurate, it means Robert Mueller is only looking at testifying before the House – and he’s not interested in testifying before the Senate, where the committees are all controlled by Trump’s Republican sycophants. Mueller may have made this decision after watching how Trump puppet Lindsey Graham tried to make such a mess of yesterday’s Senate Judiciary Committee hearing. In any case, Mueller is making his move.
